These conditions apply only to products or services sold on the website www.boutique.france-galop.com as well as direct purchases in stores. These conditions are addressed to a buyer who has full legal capacity. These conditions apply to all orders placed with www.boutique.france-galop.com. In case of modification, the general terms of sale valid on the day of the order will apply to each order. Beyond this area, specific pricing and delivery conditions apply depending on the buyer’s location and the final destination of the product. ARTICLE 3 - PRODUCT AVAILABILITY Upon receipt of the order, www.boutique.france-galop.com checks the availability of the ordered product(s). If any products are unavailable, we commit to either delivering the ordered product, offering a similar product at a similar price, or refunding the purchase within 30 days of the order validation. The date of order validation corresponds to: The date of payment, in the case of online payment by credit card. The date of receipt of the transfer, in the case of payment by bank transfer (or Paypal). In case of an exceptional stock shortage of one of the products in your order, we can ship the rest of your order with your consent. In the case that a product is unavailable after the order has been placed, the customer will be informed by email. ARTICLE 5 - ORDER PROCESSING AND VALIDATION An order consists of several steps: The buyer’s request. The company’s validation of the request. The buyer’s payment for the product(s). Any orders placed on www.boutique.france-galop.com consist of 4 steps: Adding items to the cart. Entering your billing and delivery details. Order summary and final validation. Non-Payment www.boutique.france-galop.com reserves the right to refuse to deliver or honour an order from a customer who has not fully or partially paid for a previous order or with whom a payment dispute is ongoing. We consider a default of payment to occur 30 days after the order date or if the payment method used could not be validated (invalid transfer, bank blockage, etc.). ARTICLE 7 - DELIVERY METHODS AND TIMEFRAMES For delivery in metropolitan France: Products are delivered to the delivery address given when placing the order. All shipments are insured at the actual value of the goods. We recommend systematically checking the goods at the time of delivery. We decline all responsibility in case of delays due to strikes, natural disasters or force majeure. Shipping Timeframes Any item available in stock is shipped within 48 hours maximum. The announced timeframes are average timeframes that correspond to the processing, preparation and shipment time of your order. Delivery Timeframes The ordered product(s) are delivered via the services we offer: GLS, TNT, tracked letter, Colissimo, Chronopost, DHL or Mondial Relay. The choice of delivery method depends on the weight, volume and value of the items. Upon Delivery You must check the conformity of the delivered goods at the time of delivery and before signing the delivery note from the carrier. ARTICLE 9 - RIGHT OF WITHDRAWAL In accordance with Article L.121-21 of the Consumer Code, the buyer has a period of 14 working days from the date of the conclusion of the sales contract. In the case of www.boutique.france-galop.com, this is the date of delivery of the complete order to the customer. The buyer may return any item that does not suit them and request an exchange or refund without penalty, except for return shipping costs, which will be at their expense. The product must be returned in good condition, accompanied by all its accessories, and not used. If possible, they should be returned in their original packaging and must not have been opened or used. Any item that has undergone a specific modification for the buyer cannot be the subject of a withdrawal request. To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period expires. ARTICLE 10 - RETURN AND EXCHANGE POLICY To benefit from a refund or exchange of an item, the buyer has a period of 14 days from receipt of the order to return it at their expense (Article L.121-21 of the Consumer Code). www.boutique.france-galop.com will proceed with the full refund of the amounts paid (except for shipping costs) upon receipt of the products or as soon as the return of the products is confirmed. The refund will be made via the same payment method used during the order, except in the case of a mutual agreement between the buyer and www.boutique.france-galop.com. ARTICLE 11 - WARRANTY AND AFTER-SALES SERVICE According to Article L. 211-4 and subsequent of the French Consumer Code and Articles 1641 and following of the French Civil Code, the buyer benefits from a legal warranty against hidden defects, and the seller is responsible for any defects in conformity. In case of non-conformity, the product may be returned, exchanged or refunded. All claims, exchange or refund requests must be made within 30 days of delivery by email: contact@sporeo.fr or by phone. Products must be returned in the condition they were received with all elements (accessories, packaging, instructions, etc.). Shipping costs will be refunded based on the charged rate, and return costs will be refunded upon proof of the product's defects. The provisions of this article do not prevent you from benefitting from the right of withdrawal provided for in Article 9 of these terms of sale. ARTICLE 12 - APPLICABLE LAW IN CASE OF DISPUTES The language of this contract is French. These terms of sale are subject to French law. In case of dispute, the Saint-Etienne court will be the only competent court. ARTICLE 13 - INTELLECTUAL PROPERTY All elements of the website www.boutique.france-galop.com are and remain the intellectual and exclusive property of Sporeo. No one is authorised to reproduce, exploit, distribute or use in any capacity, even partially, elements of the website, whether software, visual or audio.
